Terms of Service

By commissioning me (antlerdads) in any way you are agreeing to the terms of service below. These terms of service will be repeated on any invoice sent to you, for your personal records.These terms are subject to change without notice. Revisions apply to commissions ordered after the most recent revision.Last revised: 03/05/2024

General

Communication between you (hereafter known as the client) and I (hereafter known as the artist) will occur prior to and during the commission process.The client is expected to provide clear reference (either visual or thoroughly written) of their request.The artist will check in with a progress report after the sketching and (when not given colour reference) colour selection stages before continuing work so as to ensure the client is satisfied with how the piece is developing.If the client does not respond to a progress report within 2 weeks of receiving it, the commission will be put on hold until communication is re-established. If the client does not re-establish communication within 3 months, the commission will be terminated without refund.The client may request smaller changes and one full rework at the sketching stage. Additional changes at any stage are subject to additional fees at the artist's discretion, up to and including paying the original price again if large edits are requested when the commission is complete or nearly so.The artist reserves the right to decline any commission request received, with or without a reason being disclosed.Harassment or abuse from the client will result in the commission being cancelled without refund, and the client will be blacklisted from requesting the artist's services in the future.

Rights/Permissions

In no way is the client or anyone else permitted to use the artists work for AI, NFTs or any cryptocurrency based means. Any attempted use in this way will be countered by the artist to their utmost ability.All commissioned work is for non-commercial use only. If the client wishes to use the artist's work commercially (for-profit of any kind) a unique contract will be drafted with different rates and terms of service.The artist retains full rights to all work produced by commission unless otherwise agreed upon with a new price and contract drawn.The client is paying for the artist to produce a digital product. No physical product will be offered, unless otherwise agreed upon with a new price negotiated.The artist does not claim ownership of any intellectual property featured in a commission, except in the case of intellectual property (eg. custom designs) created by the artist.
When applicable, the client agrees to allow depiction of their intellectual property (eg. original characters) in an exclusively non-commercial capacity.The artist retains the right to showcase the commission on social media, in portfolios etc. if the artist wishes. The client may request for art to not be shared publicly by the artist, but in doing so the client waives the right to publicly share the commission themselves. The client is free to request the artist does not attach the clients name or username(s) to the commission when publicly shared.The client may never claim the commission as their own work or redistribute it. Non-commercial replication of the commission (eg. personal, non-commercial printing) must be discussed and agreed upon by the artist prior to work starting.Work by the artist will come with a non-obstructive watermark. Removal of this watermark is prohibited under any circumstances, and if the art is shared in a capacity where the watermark is not visible (due to size, cropping, etc.) clear credit must be given alongside the work shared.

Payment/Refunds

Payment is conducted exclusively through PayPal invoice, unless otherwise agreed upon prior to work starting. All payment is required in GBP - the client is expected to be mindful of conversion rates if applicable.Full or part payment is required up-front - work totalling £50 or over requires a 50% deposit paid prior to the artist starting the commission. Work totalling less than £50 requires full payment up-front.Once the client has paid a 50% deposit, the artist will provide watermarked sample versions of the completed work and will request the rest of the payment to be sent before the full versions of the work will be sent to the client.In accordance with the Late Payment of Commercial Debts (Interest) Act 1998, the artist is entitled to claim a £40 late fee if the client fails to pay the rest of the total within 30 days of receiving the invoice in the case of commissions that are paid with the 50% deposit. After 30 days of non-payment a revised invoice with this charge will be sent. If payment of the revised invoice is not received within a further 14 days, additional interest will be charged to the overdue account at a statutory rate of 8% plus Bank of England base rate of 0.75%, totalling 8.75%.The client may at any time request to cancel the commission for any reason, and refunds will be calculated based on work completed at that point. If the commission's progress is no further than the end of the sketching stage, the client is entitled to receive a refund for 75% of the full cost of the work. If the cancellation is requested after this point, the client is entitled to receive a refund for 50% of the full cost of the work. Refunds are not available for completed commissions. Refunds are given per piece in the case of orders placed for multiple pieces of art.The artist may cancel the commission at any time for any reason, but will contact the client to discuss the issue. Any cancellation made by the artist entitles the client to a full refund.
